Terms of service
1. Purpose
These TERMS AND CONDITIONS, from now on “T&C” regulate the use of the websites of NMZ DISEÑOS S.A.S., a commercial company, with Tax Identification Number 901.025.424-6, registered office located in the Capital District of Bogotá, and referred as “NMZ” or the “COMPANY” or “WE.” The T&C includes access, navigation, and use of the services offered by the COMPANY on their websites.
The T&C requires compulsory compliance to whoever uses the NMZ’s websites (from now on the “USER” or “USERS”). NMZ reserves the right to update or modify its T&C at any time without prior notice; therefore, we recommend that you review the TERMS AND CONDITIONS whenever you use any of the COMPANY’s websites.
The access to NMZ’s websites and the use of their content and services implies that you have read, understood, and accepted the published regulatory standards applicable to T&C at the time of access or use. If you do not agree with them, you have the option not to provide any personal information, or not to use the websites of the COMPANY. 2. Intellectual property rights
All multimedia content on NMZ’s web pages, including, but not limited to, images, illustrations, graphics, audio clips, video clips, and text is subject to industrial property rights or copyright or other intellectual property rights owned or licensed by the COMPANY and may not be used by the USERS without prior authorization from NMZ or its licensee.
3. Full legal capacity
Access, navigation, and use of the COMPANY’s websites are reserved for people over 18 years old, and the inclusion of children and adolescents as authorized USERS of the websites is prohibited. By accepting the T&C, you state that you are over 18 years old and entirely responsible for this declaration.
4. Limitation of guarantees and liabilities
The USERS accept that the use of the NMZ’s websites is at their own risk. The management of the websites and the information published on them is the sole responsibility of the USER according to the terms provided in this T&C. By accessing the COMPANY’s websites, the USERS understand and accept that browsing the websites do not in itself constitute or give rise to any kind of contractual relationship between the COMPANY and the USERS.
WE reserve the right to interrupt, suspend, or temporarily remove NMZ’s websites to make improvements or changes to the services or programs described on this site at any time and without prior notice.
The COMPANY will not be responsible for any content created, published, or made available by the USERS, except for those expressly established by law.
5. Habeas data or protection of personal data.
NMZ collects personal data, with the prior express authorization of the USERS. The personal data collected is used by the COMPANY, and by the media for the purposes established in the personal data processing policy of our COMPANY, and will be treated under the provisions of the Law 1266 of 2008, the Statutory Law 1581 of 2012 of the Political Constitution of Colombia and those rules that regulate, modify, replace or supplement them.
The COMPANY may make modifications to its personal data processing policy.
6. Requests, complaints, or claims.
The USER, at any time, if he or she considers it necessary, may submit requests, complaints or claims regarding the content presented by NMZ on its websites by contacting the COMPANY through the following e-mail address info@shopnmz.com
7. Applicable law
The differences between NMZ and the USERS, related to the interpretation, compliance, and validity of the T&C will be governed by the applicable Colombian law, regardless of the legal environment of the user. Any dispute that may arise in the interpretation of these terms will be resolved under the protection of the Colombian jurisprudence.
8. Product information
The descriptions of the products exhibited on the NMZ’s websites will be made by the COMPANY under the current and applicable regulations of the Colombian legal system.
9. Correction of errors and inaccuracies.
The information on NMZ’s websites may contain typographical errors or inaccuracies and may not be completed or up-to-date. Therefore, we reserve the right to correct any errors, inaccuracies, or omissions and to change and update the information at any time without prior notice. Please note that such errors, inaccuracies, or omissions may relate to product description, pricing, and availability.
If a product offered by NMZ is listed at an incorrect price due to a typographical or system error, the COMPANY shall have the right to refuse or cancel the order and is obliged to inform the USERS at the time of the refusal or cancellation of the order.
10. Prices
The prices of the products displayed on the NMZ’s web pages will be under current and applicable regulations of the Colombian legal system; the prices and promotions on the NMZ’s web pages may differ from those of the COMPANY’s commercial establishments.
The prices of the products do not include expenses corresponding to the shipping of the products, which will be detailed separately, and which will have to be expressly accepted before purchasing the product.
11. Right of withdrawal, returns, and exchanges.
NMZ will apply the current consumer protection laws pertaining the operations carried out by the USERS, who may exercise their right of withdrawal the purchase of a product within (5) five business days after receipt of the goods, and provided that the nature and condition of the goods allow it and that the packaging is the same as the one in which it was received. To make a withdrawal, return or exchange of your purchase, you must contact us at info@shopnmz.com or by calling the customer service line in Bogotá, Colombia +57 302 2678849.
Under no circumstances, NMZ will make partial reversals of the value of a product. The return of products purchased by the USERS on the NMZ’s web pages must be managed within five (5) calendar days from the date of the delivery of the product and the exchanges within thirty (30) calendar days, by calling the customer service line in Bogotá, Colombia +57 302 2678849.
12. Shipping and delivery times.
NMZ ships its products to all cities and municipalities of the Colombian territory after confirmation of payment by the USER. Shipments are made through a transport company chosen independently by the COMPANY, which determines the delivery times. In case the USERS have any concern with the delivery of the product, they can contact Customer Service line in Bogotá, Colombia +57 302 2678849 or through our mail info@shopnmz.com
The product may be received and inspected by any person of legal age who lives or is present at the place of delivery, for which the signature of the carrier’s guide shall be sufficient. If the product has signs of damage or if the original packaging is damaged at the time of delivery, the USER must record it in the carrier’s guide and contact Customer Service line in Bogotá, Colombia +57 302 2678849 or through our mail info@shopnmz.com
13. Shipping costs.
The shipment of the orders is free throughout the country for purchases equal or greater than three hundred and ninety thousand COP ($390.000,00), for purchases below to this value, the cost of the shipment will be determined in each particular case depending on the destination, weight, and volume of the package. This value will be calculated in the purchase process and will be informed at the time of the order settlement before the USERS make the payment.
14. Cookies.
WE use cookies on NMZ’s websites. Cookies are pieces of information sent by the COMPANY’s websites and stored in your browser. The purpose is to give the USERS a better browsing experience on our websites and improve our services.
